These terms govern your use of the SwiftUIBase website and any purchase you make through it. The kit itself is licensed under a separate End-User License Agreement.
1. Acceptance
By visiting swiftuibase.com or completing a purchase, you agree to these terms. If you do not agree, do not use the site.
2. The site and the kit
SwiftUIBase is a SwiftUI iOS starter kit operated by Pull House LLC (“Pull House”, “we”). The site provides marketing information, documentation, and a checkout flow. Use of the kit itself is governed by the End-User License Agreement (EULA), which you accept when you purchase or download the kit.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. If you purchase on behalf of an organization, you represent that you have authority to bind that organization to these terms and the EULA.
4. Purchase, pricing, and payment
- Prices are listed in US dollars unless stated otherwise. Stripe performs any required currency conversion at the rate published at checkout.
- Applicable VAT, GST, sales tax, or similar consumption tax is added at checkout where required by your local law and is collected by Stripe Tax on our behalf.
- Payments are processed by Stripe, a PCI DSS Level 1 certified payment processor. We do not see, store, or transmit full payment-card details. Strong Customer Authentication (3DS 2 / PSD2) and other card-network rules are handled by Stripe end-to-end.
- Promotional pricing (such as the early-bird offer) is available while supplies last and may end without notice. Once the early-bird allocation is filled, the price returns to the standard rate.
- On successful purchase, you receive an email with onboarding instructions and a private GitHub repository invitation.
5. Account and access
Repository access is tied to the GitHub username you provide at purchase. You are responsible for maintaining the confidentiality of your GitHub account credentials. Do not share collaborator invites or clone URLs with anyone outside the licensed Licensee’s direct development team. See the EULA for full restrictions.
6. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or otherwise interfere with the site or the kit’s distribution.
- Use the site or the kit to develop or distribute unlawful, harmful, fraudulent, infringing, or objectionable content.
- Use automated means (bots, scripts) to interact with the site beyond standard browser behavior.
- Attempt to circumvent license restrictions, share access tokens, or re-license the kit to others.
7. Intellectual property
All content on the site (logos, text, design, screenshots) is owned by Pull House or its licensors and protected by copyright and trademark law. You may not reproduce or republish the content without our written permission, except for short excerpts used in commentary/review with attribution.
8. Refunds
Refunds are governed by the separate Refund Policy. The 14-day refund window applies before you have accessed the GitHub repository; once you have cloned the kit, the digital good is considered delivered and refunds are not available.
9. Updates and modifications
We may modify, suspend, or discontinue any part of the site or the kit’s distribution at any time. Lifetime updates to the kit, as described in the EULA, remain available through the GitHub repository.
10. Third-party links and services
The site and the kit reference third-party services (Stripe, GitHub, Apple, and SDK providers). We are not responsible for the content, terms, or practices of those third parties. Your use of them is governed by their own terms.
11. Disclaimers
The site and the kit are provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
12. Limitation of liability
To the maximum extent permitted by law, Pull House’s total liability under these terms and any related agreement is capped at the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, lost data, or business interruption.
13. Indemnification
You agree to indemnify and hold Pull House harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of (a) your violation of these terms or the EULA, (b) your Derived Applications, including their content, marketing, and compliance with applicable law, and (c) your infringement of any third-party right.
14. Termination
We may suspend or terminate your access to the site or repository if you breach these terms or the EULA. Termination does not entitle you to a refund and does not terminate any rights or obligations that by their nature should survive (intellectual property, limitation of liability, indemnification, governing law).
15. Governing law and your local rights
These terms are governed by the laws of [JURISDICTION], United States, without regard to conflict-of-law principles. Disputes will ordinarily be resolved in the courts located there.
Consumer-protection rights prevail.If you are a consumer purchasing for personal (not business) use, the mandatory consumer-protection laws of your country of habitual residence apply to you regardless of this clause, and nothing here deprives you of those non-waivable rights. Where local law grants you the right to bring an action in your own country’s courts, that right is preserved.
We comply with the regulations of the card networks (Visa, Mastercard, American Express, and others) and the rules of our payment processor as they relate to chargebacks, dispute handling, and fraud prevention.
16. Changes to these terms
We may update these terms by posting a revised version at this URL. Material changes will be announced via the launch updates email if you’re subscribed. Continued use of the site after the revision date constitutes acceptance.
17. Entire agreement
These terms, together with the EULA, Privacy Policy, and Refund Policy, are the entire agreement between you and Pull House regarding the site and the kit.
